1. Definitions

“Roofigari,” “we,” “us,” or “our” refers to Roofigari.org and its owner/operator. “You” or “your” means the person accessing the site or placing an order. “Products” means apparel and accessories listed on Roofigari.org, including Godspeed shirts and related items.

2. Eligibility & Account

• You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase.
• You are responsible for maintaining the confidentiality of your account and for all activity under it.
• Provide accurate, complete, and current information. We may suspend or terminate accounts for violations.

3. Ordering & Acceptance

• Your order is an offer to buy. We may accept or reject any order at our sole discretion.
• Order acceptance occurs when we send a shipment confirmation with tracking. Order confirmation emails are not acceptance.
• We may cancel orders for suspected fraud, bot activity, reselling, or stock discrepancies.

4. Pricing, Taxes & Currency

• Prices are listed in USD and exclude taxes and shipping unless stated otherwise.
• Applicable sales tax is calculated at checkout based on delivery address.
• International customers are responsible for duties, VAT, and import fees assessed by the destination country.
• We reserve the right to change prices at any time prior to acceptance of your order.

5. Payments & Authorization

• We accept major cards and other methods shown at checkout (e.g., Mastercard, Visa, PayPal).
• By submitting a payment method, you represent that you are authorized to use it and authorize us to charge the full amount, including taxes, shipping, and any applicable fees.
• Orders may be subject to pre‑authorization and verification. We may cancel or refuse transactions that fail verification checks.

6. Shipping, Risk & Title

• Shipping options, costs, and estimated timelines are shown at checkout and further described in our Shipping Information.
• Risk of loss and title pass to you upon our delivery of the Products to the carrier.
• Delivery estimates are not guarantees. Weather, customs, and carrier delays may occur.
• Please inspect packages on arrival and contact us promptly about any issues.

7. Pre‑Orders & Limited Drops

• Quantities are limited. Carting a Product does not reserve it.
• Pre‑order shipping windows are estimates and may shift due to production or supply constraints.
• We may limit or cancel orders per person/household to ensure fair access and reduce bot abuse.

8. Authenticity & Condition

• All Products are verified authentic via our multi‑point inspection covering labels, prints, fabric weight, stitching, measurements, and condition.
• Each listing includes measured specs; minor variances may occur due to manufacturing tolerances.
• Color may appear differently on screens due to display settings and lighting.

9. Returns, Exchanges & Cancellations

• Returns are accepted within 30 days on unworn items with original tags and packaging. See our Refund & Returns Policy for full details.
• Final sale items, limited drops, and discounted items may be ineligible for return; eligibility will be noted on the Product page.
• To request a return or exchange, contact [email protected] with your order number before sending any item back.
• Order cancellation requests can be made prior to shipment; approval is not guaranteed due to processing speed and limited inventory.

10. Promotions, Coupons & Gift Cards

• Promotional codes must be entered at checkout and cannot be applied retroactively.
• Unless stated, promotions cannot be combined and exclude taxes, shipping, and certain items.
• We may modify or cancel promotions at any time.
• Gift cards (if offered) are non‑refundable and redeemable only at Roofigari.org.

11. Availability, Quantity Limits & Errors

• We strive for accuracy but may occasionally list errors in price, stock, or descriptions. We may correct such errors and cancel affected orders prior to acceptance.
• We reserve the right to limit quantities per customer or order.

12. Acceptable Use & Prohibited Conduct

• No scraping, automated purchasing, or circumventing security or quantity limits.
• No use of the site for fraudulent, illegal, or infringing activities.
• We may restrict access or cancel orders for suspicious or abusive behavior.

13. Intellectual Property

• All site content, including text, graphics, logos, and images, is owned by Roofigari or its licensors and protected by applicable laws.
• You may not copy, reproduce, distribute, or create derivative works without prior written permission.

14. Reviews & User Content

• By submitting reviews, photos, or comments, you grant us a non‑exclusive, worldwide, royalty‑free license to use, reproduce, and display such content in connection with the site and our marketing.
• You represent that you own or have rights to any content you submit and that it does not violate others’ rights or applicable law.

15. Third‑Party Links & Services

• We may link to third‑party sites or services. We are not responsible for their content, policies, or practices.
• Your interactions with third parties are solely between you and the third party.

16. Disclaimers

• Except as expressly stated, Products are provided “as is” without warranties of any kind, to the fullest extent permitted by law.
• We do not guarantee uninterrupted or error‑free site operation.

17. Limitation of Liability

• To the fullest extent permitted by law, in no event shall Roofigari be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data.
• Our total liability for any claim shall not exceed the amount you paid for the Product giving rise to the claim.

18. Indemnification

You agree to defend, indemnify, and hold harmless Roofigari and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising from your breach of these Terms, your violation of law, or your misuse of the site.

19. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

20. Dispute Resolution

• Binding arbitration: Any dispute not resolved informally shall be resolved by binding arbitration in New York County, NY, on an individual basis. You waive the right to a jury trial or to participate in a class action.
• Small claims: Either party may bring an eligible claim in small claims court in New York County, NY.

21. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date reflects the latest changes. Your continued use of the site after changes become effective constitutes acceptance of the revised Terms.
